The General Protection of Personal Information Law (LGPD), passed in August 2018, came into effect on September 18th. This legislation effectively regulates any operation involving the processing of personal data, such as the collecting, processing, viewing, sharing and storing of information of a personal nature. All personal data needs to be properly treated and stored, with the risk of companies being subject to penalties, ranging from a simple warning to fines.
The purpose of the law is to protect citizens from the misuse of their personal information and to guarantee the fundamental rights of freedom and privacy. In other words, from now on, consumers can demand that any personal information collected by companies, whether digitally or physically, is not used or even that it be deleted.
The law is valid throughout all Brazilian territory and is also extraterritorial in nature (applying to events occurring outside the national territory), covering all organizations, both public and private, and individuals who provide goods and services and handle the processing of personal information about their customers.
